Before using these services, please read and understand the entire content of this agreement carefully. By indicating your acceptance through means such as checking a box on a web page or otherwise selecting to accept this agreement, you signify that you have read, understood, and agree to be bound by all terms of this agreement.
DataEyes: Refers to DataEyes Co., Ltd. and its affiliated companies that provide the API services.
API Services: Refers to the application programming interfaces and related services provided by DataEyes through its website or related platforms, for use by developers in their developed applications.
Developer: Refers to the individual, legal person, or other organization using the DataEyes API services, i.e., "You" under this agreement.
Application: Refers to the software, website, or other application products developed by the Developer that utilize the DataEyes API services.
This agreement is a legal agreement between you and DataEyes concerning the use of the API Services and applies to your use of the API Services. In addition to this agreement, other relevant rules and policies of DataEyes, such as the Privacy Policy and Legal Statement, are integral parts of this agreement and have the same legal effect as this agreement.
DataEyes provides you with API Services pursuant to this agreement, including but not limited to data query, data push, and function call services. Specific service content is subject to what DataEyes publishes on its official website or related platforms. DataEyes reserves the right to update, upgrade, or adjust the API Services based on business development needs and will notify you through the official website or other reasonable means.
DataEyes grants you a non-exclusive, non-transferable, limited license to use the API Services under the premise of complying with this agreement. You may only use the API Services within the scope permitted by DataEyes and shall not use the API Services for any illegal purpose or in violation of this agreement. You shall not reverse engineer, decompile, disassemble, or attempt to derive the source code of the API Services, among other similar actions.
You should be a natural person, legal person, or other organization with full capacity for civil rights and civil conduct. You need to ensure that you are not subject to trade restrictions, sanctions, or other legal or regulatory limitations implemented by any country, international organization, or region.
You must complete the registration process by providing information as prompted on the registration page of the DataEyes website and reading and agreeing to this agreement before you can obtain an API service account. You shall keep your account and password safe and shall not transfer, gift, or bequeath the account to others. If you discover any unauthorized use of your account, you shall notify DataEyes immediately.
When using the API Services, you shall ensure that your Application complies with legal and regulatory requirements and shall not use the API Services to collect, store, or disseminate any illegal or non-compliant information. You agree that DataEyes may collect and use personal information of you and the end users of your Application as necessary for providing the services. DataEyes will protect users' personal information in accordance with its Privacy Policy.
DataEyes will take reasonable measures to protect the security of your account information and will not disclose your information to third parties unless required by laws and regulations or otherwise agreed between DataEyes and you. DataEyes products fully comply with domestic and overseas data privacy laws and regulations and have adopted measures such as data hard isolation to ensure data security.
The intellectual property rights of the API Services, related technologies, documentation, data, etc., provided by DataEyes belong to DataEyes. You only have the right to legally use the API Services within the authorized scope according to this agreement. Without the written permission of DataEyes, you shall not copy, modify, distribute, or otherwise handle the API Services and related content.
To the extent permitted by applicable law, DataEyes shall not be liable for any indirect, punitive, special, or consequential damages arising from the use of the API Services. DataEyes assumes no responsibility for the consequences of your use of the API Services, and you shall bear the risks associated with using the API Services yourself.
DataEyes shall not be liable for damages if service interruption or malfunction is caused by force majeure or other unforeseeable, unavoidable factors.
DataEyes has the right to revise this agreement based on business needs and will notify you through the official website or other reasonable means. If you do not agree to the revised agreement, you have the right to terminate the use of the API Services.
Either you or DataEyes may terminate this agreement at any time. After the termination of the agreement, you shall cease using the API Services and delete all data obtained through the API Services.
The execution, validity, interpretation, performance, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China.
Any dispute arising from this agreement shall be resolved through friendly negotiation between the parties; if negotiation fails, either party has the right to file a lawsuit with the People's Court where DataEyes is located.
DataEyes may send notices to you via official website announcements, email, SMS, etc. Notices are deemed delivered upon successful sending.
The section headings in this agreement are for convenience only and have no legal or contractual effect. If any provision of this agreement is deemed void, invalid, or unenforceable, it shall not affect the validity and enforceability of the other provisions.
